A claim for a declaration of the right of the transferee - who becomes insolvent during the pendency of the proceedings - to continue the employment relationship falls within the jurisdiction of the employment tribunal when it is not instrumental to the (concurrent) claims for differences in salary and damages.
This is the principle expressed by the Court of Cassation in judgment no. 23528 of 27 August 2021.
