Corte di Cassazione, sezione lavoro, Ordinanza 16 marzo 2022, n. 8567<\/em><\/p>\n

Court of Cassation, Order No. 8567 of 16 March 2022\nA genuine procurement contract is distinguished from the supply of labor by the organisation of the necessary means and the assumption of the risk by the contractor and may be compatible with the partial use of means owned by the principal.\n\nIn the present case, the Court of Appeal - upholding the decision of the court of first instance - rejected the request of an employee of the contracting company to ascertain the simulation of the service contract - concerning the ordinary maintenance, cleaning and custody of the principal's sports facility - with the recognition of the existence of a subordinate employment relationship with the principal, or of coordinated and continuous collaboration and the restoration of the employment relationship.\n\nThe Court of Appeal held that there was a hypothesis of assumption by the contractor of the business risk and that there was no case of supply, in light of the organisation of necessary means and of the assumption of risk by the contractor, despite the partial use, considered compatible with a genuine contract, of means owned by the principal.\n\nIn particular, the Court of Appeal, in a decision upheld by the Court of Cassation, had ruled out the possibility of a non-genuine contract, investigating the overall conduct of the contractor which, according to the evidence, had not merely sent its own employees to the principal company to carry out any work, but had organised the commissioned activity with its own means and assumed the business risk.\n\nThe court of second instance, as stated in the order in question, had pointed out \u201chow in this regard it was not decisive in the opposite sense the use of equipment of the contractor as well as the use of its own employee unquestionably by him heterodirected, not being able to exclude that the ratio of this choice was to be attributed to the guarantee of the quality and characteristics of the service performed\u201d. \n\nNot only that, but also the behaviour of the parties when entering into the contract, with the submission of a request for certification of the contract, further enhanced the genuineness of the contract.\n\nAnd so, continues the Court of Cassation \u201cin ruling out any element of supply or quasi-subordination, and moreover of subordination, the Court also relied on the fact, which was common knowledge between the parties, that the contract was entered into with the assistance of their lawyers, pointing out that both parties - including the appellant who then challenged its nature - had applied for certification of the contract in question\u201d. \n\nIn that application for certification, the employee stated: \u201ca) that the organization of the means necessary to carry out the contract was the responsibility of his company, b) that he would use an employee to carry out the contract, c) that he had the technical capacity to carry out the contracted work independently, carrying out that activity for several clients, d) that he had agreed on a fee which was independent of the hours of work required and the number of workers used, having complied with the legal obligations regarding health and safety at work regulations\u201d.\n\nIn light of the above, the Court of Cassation, noting that a different assessment would entail an inadmissible assessment of the merits, dismisses the case and confirms the judgment under appeal.<\/p>\n

Nel caso di specie, la Corte d\u2019Appello, confermando la decisione del giudice di primo grado, rigettava la domanda di un lavoratore della ditta appaltatrice di accertamento della simulazione del contratto di appalto di servizio – concernente la manutenzione ordinaria, la pulizia e la custodia dell\u2019impianto sportivo del committente – \u00a0con riconoscimento della sussistenza di un rapporto di lavoro subordinato con il committente, ovvero di collaborazione coordinata e continuativa ed il ripristino del rapporto di lavoro.<\/p>\n

La Corte d\u2019Appello riteneva sussistesse un\u2019ipotesi di assunzione da parte dell\u2019appaltatore del rischio d\u2019impresa e l\u2019inconfigurabilit\u00e0 di una fattispecie di somministrazione, alla luce dell\u2019organizzazione di mezzi necessari e per l\u2019assunzione del rischio da parte dell\u2019appaltatore, quanto precede nonostante il parziale uso, ritenuto compatibile con un appalto genuino, di mezzi di propriet\u00e0 del committente.<\/p>\n

In particolare, la Corte d\u2019Appello, con decisione confermata in Cassazione, aveva escluso che ci si trovasse di fronte ad un appalto non genuino, indagando sul complessivo comportamento dell\u2019appaltatore che, secondo quanto ricostruito sulla base delle risultanze probatorie, non si era limitato ad inviare propri dipendenti presso l\u2019azienda committente per svolgere qualsivoglia attivit\u00e0 lavorativa, ma aveva organizzato con i propri mezzi e con l\u2019assunzione su di s\u00e9 del rischio d\u2019impresa l\u2019attivit\u00e0 commissionata.<\/p>\n

Il giudice di secondo grado, come si legge nell\u2019ordinanza in esame, aveva evidenziato \u201ccome a tale riguardo non fosse determinante in senso contrario l\u2019utilizzazione, quasi integrale, di attrezzature dell\u2019appaltante nonch\u00e9 l\u2019utilizzazione di una propria dipendente pacificamente da lui eterodiretta, non potendo escludersi che la ratio di tale scelta fosse da attribuirsi nella garanzia della qualit\u00e0 e delle caratteristiche del servizio espletato<\/em>\u201d.<\/p>\n

Non solo, ad ulteriore valorizzazione della genuinit\u00e0 dell\u2019appalto anche il comportamento delle parti in sede di stipulazione del contratto, con la presentazione di istanza di certificazione del contratto.<\/p>\n

E cos\u00ec, prosegue la Corte di Cassazione \u201cnell\u2019escludere qualsiasi elemento della somministrazione, ovvero della parasubordinazione, e vieppi\u00f9 della subordinazione, la Corte ha altres\u00ec valorizzato la circostanza, pacifica fra le parti, della stipula del contratto con l\u2019assistenza di difensori delle medesime evidenziando come entrambe le parti – compreso il ricorrente che ne ha poi contestato la natura – \u00a0abbiano avanzato, riguardo al contratto in questione, istanza di certificazione del medesimo<\/em>\u201d.<\/p>\n

In tale istanza di certificazione, il lavoratore ricorrente \u00a0ha dichiarato: \u201ca) che l\u2019organizzazione dei mezzi necessari alla realizzazione dell\u2019appalto competeva alla sua ditta, b) che avrebbe utilizzato un operaio per l\u2019esecuzione dell\u2019appalto; c) che aveva la capacit\u00e0 tecnica per svolgere in autonomia i lavori appaltati, esercendo tale attivit\u00e0 per diversi committenti, d) di aver pattuito un corrispettivo indipendente dalle ore di lavoro necessarie e dal numero di lavorato utilizzati, avendo adempiuto agli obblighi di legge in merito alle norme di igiene e sicurezza sui luoghi di lavoro<\/em>\u201d.<\/p>\n

Alla luce di quanto precede la Corte di Cassazione, rilevato che una diversa valutazione comporterebbe una inammissibile valutazione del merito, respinge il ricorso e conferma la sentenza impugnata.<\/p>","protected":false},"excerpt":{"rendered":"
